At Setu, we respect your privacy and are committed to protecting your personal information. This Privacy Policy has been drafted in accordance with the Information Technology Act, 2000, the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011 and/or other applicable laws that require publishing of a Privacy Policy for collection, usage, storage, disclosure and transfer of personal data or information.

This Privacy Policy outlines how we collect, use, share, and protect your information when you interact with Setu Platform. Please note that this Privacy Policy does not apply to third-party websites, applications, APIs, integrations, etc. that are used to support Setu Platform.

This Privacy Policy must be read in conjunction with the Terms and Conditions published on our website. By using Setu Platform, you agree to the practices outlined in this Privacy Policy. If you do not agree with this Privacy Policy, please do not proceed with using Setu Platform.

  1. Definitions and interpretation: Please note that any term not defined in this Privacy Policy will be understood to have the meaning prescribed in the Terms and Conditions.
    • Data Recipient: Refers to Setu and/or an NGO partner in collaboration with whom a specific Setu Chatbot has been developed.
    • Setu / We / Us / Our: Refers to Project Setu.
    • You / User: Refers to all individuals or body corporates that use or interact with Setu Platform.
    • SPDI Rules: Refers to the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011
  2. Information we collect: We may collect various types of information about you to the extent appropriate for your relationship with Setu. The information collected may be accessed by a Data Recipient. You understand and consent to the collection and processing of such information, as outlined in this Privacy Policy.
    • Personal Information: Personal information refers to information that could be used to identify you, such as your name, email address, phone number, language preferences, geographical information, gender, age, job description, and other such information you provide while using the Setu Platform.
    • Usage Data: Data about how you interact with Setu Platform, including access times, pages viewed, chatbot conversations and engagement with features.
    • Device Information: Information such as device type, operating system, and IP address to ensure optimal service functionality.
    • Sensitive Personal Data or Information: Sensitive personal data or information means personal information relating to passwords, financial information, sexual orientation, medical records and history, biometric information, and physical, physiological and mental health conditions. We do not intentionally collect sensitive personal data or information, except where necessary for providing responses to queries posed by you to a Setu Chatbot. Please note that any information that is freely available or accessible in public domain or furnished under the Right to Information Act, 2005 or any other applicable laws shall not be regarded as sensitive personal data or information.
  3. Disclaimer regarding information collected or used by third parties: This Privacy Policy does not apply to, nor do we take any responsibility for any information that is collected by any third-party integrations, API services, plug-ins, applications that are used to support and operate Setu Platform. Information collected by such third parties may be subject to their own privacy policies, which you are encouraged to review.
  4. How we use your information: We use the information collected from you for the following purposes. You hereby acknowledge and agree to the use of your information for the following purposes.
    • Service Provision: To deliver and improve our AI-powered legal literacy services, including curating and improving responses of a Setu Chatbot.
    • Communication: To send you updates, legal literacy resources, or information about Setu Platform.
    • Legal Compliance: To comply with applicable laws and/or pursuant to orders of the government or other authorities or to resolve legal disputes.
    • Analytics: Aggregated and anonymised data may be used for research and analysis.
  5. Data sharing and disclosure: Your information will be accessed by a Data Recipient and its employees. A Data Recipient may share your information, including sensitive personal data or information, with third parties in the following circumstances. You hereby agree to the sharing of your information in the following circumstances. Except as otherwise provided in this Privacy Policy, we will not disclose, publish, sell, rent, market or share your personal information with any third party without your express consent.
    • With third party service providers: A Data Recipient may share your information with third-party service providers who need to know the information in order to help operate and improve the services provided to you (e.g., vendors of cloud services).
    • For legal reasons: We may share your information with individuals, entities, government authorities, regulators and judicial bodies, to the extent, it is required to ensure compliance with applicable laws and/or pursuant to orders of the government and other authorities or to protect the rights, property, or safety of Setu, its incubators, its partners, the users of Setu Platform or the public.
  6. Storage of information: We store and process your information on cloud service provided by hosting providers within India. Some of the safeguards we use are firewalls and data encryption using SSL, and information access authorisation controls. We use reasonable safeguards to preserve the integrity and security of your information against loss, theft, unauthorised access, disclosure, reproduction, use or amendment. To achieve the same, we use reasonable security practices and procedures as mandated under applicable laws for the protection of user information. However, you should understand and accept that there is no guarantee that data transmission over the internet will be completely secure and that any information that you transmit to us is at your own risk. We assume no liability for any disclosure of information due to errors in transmission, unauthorised third-party access to Setu Platform or other acts of third parties or acts or omissions beyond our reasonable control.
  7. Retention and deletion of sensitive personal information: We retain sensitive personal information for as long as necessary to fulfill the purposes outlined in this Privacy Policy or as required by law. Once no longer needed, your sensitive personal information will be deleted or anonymised.
  8. Rights of the information provider: We ensure that you may exercise your rights in accordance with applicable laws.
    • Access information: You have the right to access all information that you have given to us, generally within one month of your request. You may send us an email at contact@setu.law with the request for the information you wish to receive.
    • Amend or delete information: If at any time you wish to amend or delete the information provided to us you may send us an email at contact@setu.law. Upon your request, we will amend or delete all of the information provided by you within 60 days, subject to any data retention requirements under applicable laws or pursuant to orders of the government or other authorities.
    • Right to not provide information: You can always opt not to provide information to us; however, please note that some information may be needed for use of Setu Platform, particularly for obtaining responses from a Setu Chatbot. In case you opt not to provide information, the Setu Chatbot may not be able to respond satisfactorily.
    • Withdraw consent: You can withdraw consent to processing information that you have given us and prevent further processing of your information, by writing to us at contact@setu.law. If you withdraw consent, we will delete all the information provided by you within 60 days, subject to any data retention requirements under applicable laws or pursuant to orders of the government or other authorities. Please note that after you withdraw your consent, you may not be able to use the services of Setu Platform.
  9. Restrictions on use: The services offered by the Setu Platform are only intended for those who are of 18 years of age or older (or the age of majority in their country of use) and otherwise competent to contract. If you are not of the requisite age, you are not to provide any information. We shall have the right to revoke the provision of services to users not compliant with the aforesaid requirement without notice.
  10. Grievance redressal: We endeavour to resolve your grievances with respect to processing your information in a timely manner. The name and contact details of our Grievance Officer are below. If you have grievance or complaint, questions, comments, concerns or feedback in relation to the processing of your information or regarding this Privacy Policy or any other privacy or security concern, please send an email to the below email ID contact@setu.law.
  11. Changes to this Privacy Policy: This Privacy Policy is subject to change from time to time. If we make changes to this Privacy Policy, we will update the “Last Updated” date at the bottom of this Privacy Policy. If you disagree with the revised Privacy Policy, please refrain from using Setu Platform.
